These Terms of Service ("Terms") govern your access to and use of the Wantly application, website, browser extension, and related services (collectively, the "Service") provided by Wantly, LLC ("Wantly", "we", "us", or "our"). By using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Wantly may create an account identifier, session, or Wantly code that gives access to your account and wishlists. You are responsible for keeping this information secure and for activity that occurs through your account. Do not share access credentials with anyone you do not trust. Contact us promptly if you believe your account or Wantly code has been lost, exposed, or used without permission.
You may use the Service only in compliance with applicable law. You may not:
You retain ownership of wishlist names, descriptions, links, images, notes, and other content you submit to the Service ("Your Content"). You give Wantly a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, display, and otherwise process Your Content only as needed to operate, secure, improve, and provide the Service. This license ends when Your Content is deleted, except where retention is reasonably necessary for backups, security, legal compliance, or dispute resolution.
You represent that you have the rights needed to submit Your Content and grant this license. You are responsible for Your Content and for deciding what information to include in a wishlist.
Private wishlists are intended to be available only to their owner. When you make a wishlist public, anyone with its link may be able to view it, share it, and reserve items. A reservation is an informational feature and does not purchase an item, guarantee its availability, or create an obligation to give or receive a gift. You can make a public wishlist private again, but copies or links previously shared by others may remain outside our control.
The Service may import or display product names, images, prices, descriptions, and links from third-party websites. This information may be incomplete, inaccurate, or out of date. Wantly does not sell the listed products, control third-party websites, or guarantee product availability, price, quality, safety, or delivery. Any purchase or interaction with a third party is between you and that third party and is subject to its terms and policies.
The Service, including its software, design, branding, and other content provided by Wantly, is owned by Wantly or its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable right to use the Service for its intended purpose. These Terms do not grant you any other rights in the Service or Wantly's trademarks.
We may add, change, suspend, or discontinue features or parts of the Service. We work to keep Wantly available, but we do not guarantee uninterrupted or error-free operation. You are responsible for keeping copies of information you cannot afford to lose.
You may stop using the Service at any time and may delete your account through the Service. We may suspend or terminate access if we reasonably believe you have violated these Terms, created risk or harm, or if required by law. We may also discontinue the Service. Provisions that by their nature should survive termination will remain in effect, including ownership, disclaimers, limitations of liability, and dispute provisions.
To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. Wantly disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service or its content will be accurate, secure, available, or free of harmful components. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.
To the fullest extent permitted by law, Wantly and its officers, employees, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or opportunities, arising from or related to the Service or these Terms. To the fullest extent permitted by law, our total liability for all claims arising from or related to the Service or these Terms will not exceed the greater of $100 or the amount you paid to Wantly for the Service during the 12 months before the event giving rise to the claim. These limitations do not apply where liability cannot be limited by law.
We may update these Terms as the Service or applicable laws change. We will update the date above and provide additional notice when appropriate. Changes will take effect when stated in the updated Terms. Your continued use of the Service after the changes take effect means you accept the revised Terms.
These Terms and the Privacy Policy are the entire agreement between you and Wantly concerning the Service. If a provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them in connection with a merger, acquisition, reorganization, or sale of assets. Nothing in these Terms limits rights that cannot be waived under applicable law.
